Terms and conditions of purchase

  1. Scope and borrower

The General Conditions of Contracting are applicable to the contracts of sale and purchase concluded electronically, through the site www.lacultivada.com, between Agraria Vecino Hens, S.L. and the consumers and users who wish to acquire the products exposed in the same one.

2. Perfection of the contract

In accordance with the provisions of the Civil Code, the contract will be understood to be perfected from the moment Agraria Vecino Hens, S.L. is aware of the acceptance of the offer by the customer.

3. Acceptance of the General Conditions of Purchase

Before proceeding with the conclusion of the contract, the customer must read the General Conditions of Purchase and accept them by checking the corresponding box during the ordering process.

4. Storage / Data Protection

The personal data you provide us, as well as those generated during the use of our services, will be incorporated into a file under the responsibility of Agraria Vecino Hens, S.L., in order to provide the requested information, manage the products or services contracted, and keep you informed about products, provided you have given your prior consent to that effect, services or news, related to the information security sector, which may be of interest to you. You authorize Agraria Vecino Hens, S.L. to receive a confirmation of receipt and reading of the communications sent to you by email.

In any case, you are guaranteed the possibility of exercising your rights of access, rectification, cancellation and opposition to the processing of your data, by sending a written communication to the address indicated above or to the e-mail address hola@lacultivada.com.

5. Price

The prices of our products contain the applicable VAT according to the current legislation. The prices mentioned on our website, including other items, are in euros. Shipping costs have not been included in the prices shown on our website with a few exceptions. Any other additional costs that may arise shall be borne by the purchaser, who shall be informed of all amounts and the resulting final price prior to the conclusion of the contract.

Deliveries to destinations outside the European Union may incur additional charges and may be subject to taxes and duties, in particular customs and import value added taxes. The totality of the expenses originated by the extra-community destination will be assumed by the buyer.

6. Shipping and delivery

We ship on business days from Monday to Friday. Orders placed between Friday afternoon and Sunday will be shipped on the Tuesday of the following week. We do not ship on public holidays and other non-business days.

Deliveries in the Peninsula: The estimated delivery time is approximately 2 to 3 business days if we receive the order before 12 p.m. If we receive it after 12:00 PM, the delivery time will be approximately 3 to 4 business days. Delivery times may be increased by 1 additional working day when delivering to very remote areas.

Deliveries to the Balearic Islands and Portugal: Deliveries to the Balearic Islands and Portugal will take 24 hours longer than those to the mainland.

Deliveries to other European countries: delivery times to other European destinations vary according to the destination in question, with the usual delivery time being between 5 and 7 working days approximately.

If you want to be informed about the status of your order, it is important that you provide us with your cell phone number and e-mail address.

We do not ship to the Canary Islands, Ceuta and Melilla.

The exact amount of shipping costs is indicated in My Cart during the checkout process, depending on the total weight of the order and the destination.

The delivery of the item will be made to the address indicated by the customer at the time of purchase. If you want to receive La Cultivada products in several different addresses, you will have to make as many purchase processes as addresses, not being able to choose more than one destination in the same purchase process.

The customer must check that the goods that arrive after the purchase correspond to those ordered.

*It is very convenient to open the packaging in the presence of the delivery person before signing the delivery note, in case any product has suffered any damage or is in bad condition.

If this is not possible, and even if the package appears to be in perfect condition, you should ask the delivery person to add a note indicating “Pending review of hidden damage”.

In case of signs of knocks or external damage to the package, you must ensure that the delivery person makes a note of this observation on the delivery note.

If any product arrives damaged due to transport, we will send a new one or refund the corresponding amount, as agreed with the customer. It is imperative that in case of damage to any product/s, please send us within 24 hours of receipt, photographs of the damaged product and its packaging to hola@lacultivada.com. Lacultivada.com will be responsible for the transportation costs, taking into account the reasons stated above. It will not be applicable if the products have deteriorated because the recipient was not available to receive the package and it had to be taken to the warehouse. For more information on this aspect, see point 7 below.

If any of the products do not correspond to your purchase made through our website, we will send you the correct products or refund the corresponding amount. Lacultivada.com will be responsible for any extra transportation costs that may arise.

7. Returns

It follows from point 6 that a return will only be accepted if the product has been damaged during transport or does not correspond to the order. In the event that the product is damaged in transit, the customer shall have 24 hours from the date of receipt of the product to report the incident. After this date, this right of return cannot be exercised.

The steps to follow in case of a damaged item will be:

7.1. Note the incident on the carrier’s delivery note when you receive it. This is valid only if you detect the anomaly immediately upon receipt of the order.

7.2. Contact us by email the same day you receive the goods. It is “conditio sine qua non” to exercise this right that the damage is reported within 24 hours after delivery, by sending an e-mail to hola@lacultivada.com.

7.3. Send photographs by e-mail to hola@lacultivada.com, within 24 hours of receipt of the order, showing the damage to the product, as well as the condition of the box/packaging together with the shipping labels.

7.4. After receiving the photo, the next steps will be communicated to you by email.

7.5. La Cultivada will bear the cost of returning the product.

7.6. You will receive the product back at no cost to you, as long as you have informed us the same day of delivery of the damage, otherwise we will not be able to take care of it.

8. Payment

We offer you the following payment methods to make your purchases on our website: Bank card (Visa, Mastercard, American Express); Paypal; bank transfer.

Please note that the goods will be delivered as soon as payment has been received. We advise you to pay by credit card, so that you receive the product in the shortest possible time.

Payments by credit card will be made through the Stripe platform, a global leader in online payments.
Stripe will be the only one that will have your bank details, being an intermediary between you and AGRARIA VECINO HENS, S.L. This payment method is immediate, at the moment you make the payment, we will receive it and process your order the next working day.

Stripe supports VISA, MasterCard, and American Express. It is a very simple system that offers the best security guarantees available.
For security reasons, if we receive a payment for an order whose delivery address is not verified by Stripe, we will refund and cancel the order.

9. Order cancellation

The customer may cancel his order by writing to our address hola@lacultivada.com within 12 consecutive hours after the order has been placed, provided that the order has not already been shipped to its destination.

10. Withdrawal

Due to the type of products offered on this website, this right cannot be applied, since they are within the exceptions defined in the Law.
